James Burt, who bought "Super Mario Brothers Wii" early in Australia after a local store mistakenly made it available days before its official release, promptly hacked the game and posted it online, according to the lawsuit filed by Nintendo.
He was accused of violating copyright law and costing the company thousands in potential sales.
"The legal proceeding resulted in a settlement in which the individual will pay to Nintendo the sum of 1.5 million (Australian) dollars by way of damages to compensate Nintendo for the loss of sales revenue caused by the individual's actions," the Japanese company said in a statement.
